Drivers
All drivers of our MX-5's must be 25 years or over.
Each driver must be named on the contract and have a full, valid driving license in their own name

from their country of residence or an international driving permit.  

Drivers licenses must be produced at the time of vehicle pick up

Deposits and Final Payments

As a small company, the requirements for a secure on line payment service are beyond our resources and hence we don't have  on-line booking page. However we have simple alternatives available for the payment of deposits.

The best way to start booking your mx-5 with us is to email us and we will respond within 24 hours. Alternatively,  you can call or skype us to discuss your requirements in detail.

If a car is available then all we need to do is get in contact by email or phone to make the arrangements
for a 10% deposit to confirm the booking.

Please don't send credit card numbers by email as it is not secure and we are not able to process it.

Full payment can be made by Visa or Mastercard when you pick up the car.

Cancellation
If you have to cancel your tour the following charges apply:
number of days before departure % of total booking price.
90 days or more =no loss of deposit

90 - 30 days = loss of deposit or 10% of total booking price

30-0 days = loss of 100% of total booking price unless the car can be rebooked.

Damage and Default

MX-5 Touring NZ Limited reserves the right to terminate the hire and take possession

of the rental MX-5 of any person who in our opinion is likely to endanger themselves

or others or if the hirer fails to comply with any of the terms of the agreement,

or if the car is damaged. Replacement of a damaged MX-5 is at the discretion of MX-5 Touring NZ Limited.

Repairs
If your car suffers a puncture,  a repair kit is supplied with the car and instructions

are included. Please make the repair and continue with caution to the next town where

the tires should be checked and repairs carried out as necessary.
All accidents and repairs are to be reported to us within 24 hours by telephone.

Automobile Association Rescue Road Cover

An AA Membership ensuring mechanical assistance at all times covers all vehicles while

on all New Zealand roads. For any other breakdowns or repairs

–up to $NZ100 arrange locally and we will reimburse. For repairs over $NZ100 we will talk directly to repairer

Use of the vehicle
The hirer shall not use or allow the vehicle to be used for the transport of passengers

for hire or reward unless the vehicle is hired with the operator’s knowledge for use in

a passenger service licensed under Part 4A of the Land Transport Act 1998 (“the Act”);

sublet or hire the vehicle to any other person;Allow the vehicle to be used outside his/her authority

Operate the vehicle or allow it to be operated in circumstances that constitute anoffence

against any of Sections 56, 57 and 58 of the Act

Operate the vehicle or allow it to be Operated in any race, speed test, rally or contest

Operate the vehicle or allow it to be operated in breach of the Act, the Transport Act1962,

the Land Transport (Road User) Rule 2004, or any other Act, regulations, rulesor bylaws relating

to road traffiC

Operate the vehicle or allow it to be operated for the transport of more passengers or goods than

the maximum specified in the certificate of loading and/or RUCcertificate, whichever is the lesser for the vehicle

Drive or allow the vehicle to be driven by any other person if at the time of driving the vehicle

the driver does not hold a current driver’s license appropriate for the vehicle

Drive or allow the vehicle to be driven on any roads excluded in  this agreement, or on any beach,

Allow the vehicle to be driven by any person who is not named or described in thisagreement

as a person permitted to drive the vehicle.

Hirer’s obligations.

The hirer shall ensure that:

a. all reasonable care is taken when driving and parking the vehicle;

b. the water in the vehicle’s radiator and battery are maintained at the proper level;

c. the oil in the vehicle is maintained at the proper level;

d. the tyres are maintained at their proper pressure;

e. the vehicle is locked and secure at all times when it is not in use

f. the distance recorder or speedometer are not interfered with;

g. no part of the engine, transmission, braking or suspension systems are interferedwith;

h. should a warning light be illuminated or the hirer believe the vehicle requires

mechanical attention, s/he stops driving and advises the operator immediately.

Driving our cars
Drivers must comply with the NZ road code. Maximum open road speed is 100kms per hour.

City speed limit is 50kms per hour and other speeds are clearly marked

MX-5 Touring NZ Limited cars must not be driven off road or on beaches, nor must they

be driven on 90 Mile Beach, Ball Hutt Road or Skippers Canyon Road.

The cars should not be left unattended at the top of Arthurs Pass or any other place

where Keas (NZ’s native parrot) are known to attack the soft rubber seals and vinyl convertible tops of cars.

All cars are non-smoking. Pets are not permitted to travel in our vehicles

Taxes
A Government Service Tax of 15% is included in all charges.

Return of cars

MX-5 Touring NZ Limited will charge $200 per day for any unreturned car at the time agreed

in writing on the hire agreement form, until the car is returned to our Christchurch premises at

488 Tuam Street undamaged. This will be deducted from the security bond deposit. Leeway will be at our discretion.

The car must be returned with a full tank of fuel. If not returned full, a handling fee and the cost of fuel

will be charged to your credit card. The cars must be returned clean and tidy and in the same condition at the start of the hire.

Car insurance
You, the hirer, will be asked to declare that you are 25 years of age or over and have not been convicted in a criminal court for any criminal offence or for driving under the influence of drugs or alcohol.

The hirer will be asked to complete an 'Agreement to Hire' form prior to starting their tour.

Our MX-5's have comprehensive insurance.

A standard Insurance is included in all car hire daily rates - Excess $NZ2,000. A security bond of $2,000 is taken on the signing of the rental agreement

by way of a signed credit card voucher which is authorised but unprocessed pending the return of the car undamaged.

If the car or any third party property has suffered damage or loss we will make an assessment of the

monetary value of such damage or loss and, under advice to you, will deduct this value from the security bond held.

A collision waiver fee of $NZ20 per day can reduce this insurance excess to $500.

Insurance exclusions

Any of the terms of the rental agreement are breached.

Damage to property is caused by careless, reckless or wilful driving including the driver being

under the influence of alcohol or drugs.

The driver's license is invalid, not current.

Damage to property is caused by submersion in water, such as river crossing, including salt water, resulting from driver negligence.

 Damage to property is caused by driving on unsealed roads, beaches or cross country.

The car was not locked overnight.

The car was being driven in an unlawful manner, such as on the right-hand side of the road

Damage due to immersion in either Salt or Fresh water for any reason and any associated costs for recovery or towing.

The vehicle is filled with the incorrect or contaminated fuel. The hirer will be responsible for any associated costs of recovery or repair.

NB's take 91and 95 octane petrol and NC's take 95+ octane only

Costs to replace lost keys or to retrieve keys locked in the vehicle.

Damage caused by theft, break-ins, conversion, vandalism, or fire damage that is directly

attributable to the negligence of the hirer or any other passenger in the vehicle.
