TERMS AND CONDITIONS
MX-5 Touring NZ Limited trading is an escorted sports car touring company based in Wellington and Christchurch. MX5 Touring South Island Limited operates tours in the South Island of New Zealand. It is a licenced rental car operator and a member of The Rental Car Association of New Zealand.
Drivers
All drivers of our MX-5's must be 25 years or over.
Each driver must have a full, valid driving license in their own name from their country of residence or an international driving permit.
Deposits and final payments
A deposit of 10% of the tour fee is required to secure a booking. We will send you a booking confirmation upon the payment of your deposit and give you details of how to make your final payment.
Final payment of the remainder of the tour fee and any charges for additional activities are due 90 days prior to the start date of your tour. Upon final payment, we will send you a detailed itinerary and description of your tour.
Cancellation
If you have to cancel your tour the following charges apply:
number of days before departure % of total booking price.
90 days or more = loss of deposit only
90 - 30 days = loss of 50% of total booking price
30-0 days = loss of 100% of total booking price
We strongly recommend that you purchase travel insurance at the time of booking your tour.
Refunds
MX-5 Touring NZ Limited is not required to refund any charges if you cancel or miss meals, activities or accommodation bookings, once the tour has commenced.
MX-5 Touring NZ Limited reserves the right to cancel a guided tour up to 30 days prior to a tour. In this unlikely event, we will refund your monies in full or offer you a guided tour on another date or arrange, with your consent, an independent tour, and we will refund the difference in cost.
Damage and Default
MX-5 Touring NZ Limited reserves the right to terminate the tour and take possession of the rental MX-5 of any person who in our opinion is likely to endanger themselves or others or if the hirer fails to comply with any of the terms of the agreement, or if the car is damaged. Replacement of a damaged MX-5 is at the discretion of MX-5 Touring NZ Limited
Repairs
If your car suffers a puncture, a repair kit is supplied with the car and instructions are included. Please make the repair and continue with caution to the next town where the tyre should be checked and repairs carried out as necessary.
Passports and Visas
You are responsible for ensuring that you have the required passport and visa to enter New Zealand. Details can be found on line at www.immigration.govt.nz/migrant/stream/visit
Mobile Phone
Each car is provided with a mobile phone. Calls to the guide/escort and emergency calls are free. Non emergency calls will be billed to the guest at the end of the tour. It is illegal for the driver to use a mobile phone whilst driving. Some areas we travel through do not have mobile phone coverage. A map included in you papers indicates these areas.
Meals
Two course evening meals are provided on our guided tours on the days specified in our tour literary .
Reimbursements
Reimbursements cannot be made for missed meals, attractions or accommodation.
Road Restrictions
Drivers must comply with the NZ road code. Maximum open road speed is 100kms per hour. Marked police cars all carry speed radars that can see up to 2kms on wide open roads and can also detect the speed of cars that are going in both directions. Speed cameras are also in operation, but mainly in cities and high traffic areas. Unmarked police cars with radar also patrol NZ roads. Laser speed guns are also a routine part of New Zealand speed enforcement proceedures.
MX-5 Touring NZ Limited cars must not be driven off road or on beaches, nor must they be driven on 90 Mile Beach, Ball Hutt Road or Skippers Canyon Road.
Taxes
A Government Service Tax of 15% is included in all charges. Any increase in GST will be added to the published prices.
Return of MX-5's
MX-5 Touring NZ Limited will charge $200 per day for any unreturned car at the time agreed in writing on the hire agreement form, until the car is returned to our premises undamaged. This will be deducted from the security bond deposit. Leeway will be at our discretion. Cars on scheduled South Island tours will be picked up and dropped off at the hotel point of departure and at the final nights accommodation hotel. All other pick ups and drop offs will be at our office at 488a Tuam Street Philipstown unless otherwise arranged.
Responsibility and Liability
MX-5 Touring NZ Limited is responsible for providing the services listed in the tour descriptions. We are not responsible for any Acts of God, strikes, weather or other events beyond our control.
MX-5 Touring NZ Limited and its employees do not assume responsibility or liability for injury, illness or death to a person or delay, loss or damage to property during their stay in connection with or relating to the supply or omission of air, sea and land transportation services or of accommodation, meals, facilities, entertainment or other services provided by MX-5 Touring NZ. You, the hirer, agree to release or indemnify MX-5 Touring NZ Limited, its owners and its employees against any liability we incur to anyone else resulting from your failure to follow our instructions. This exclusion is subject to any rights or remedies you may have under the Consumer Guarantees Act 1993.
We reserve the right to modify any part of our tours in order to provide a consistent and smooth service.
If, for reasons beyond our control, we cannot provide the MX-5 booked, then we reserve the right to substitute a comparable or superior sports car. If a comparable or superior mx5 cannot be provided, a pro rated refund for the difference will be paid. This will not constitute a breach of contract and does not entitle the client to any additional refund.
Travel Insurance
We strongly advise you to take out appropriate travel insurance at the time of booking. Please ensure that as well as the usual cover, failure to do so could result in a claim being denied for medical repatriation and its associated costs or any loss or damage to yourself and your property. It should also to cover you for loss of deposit in the event of your having to cancel your tour.
Accident Compensation Corporation (ACC)
The ACC covers New Zealand residents and visitors for medical expenses in the public system following an accident. ACC is not a replacement for travel insurance. It only covers injuries, not illnesses, and only while the person remains in New Zealand. It doesn't cover things like disrupted travel plans and lost deposits, assisted or emergency travel home or travel for family.
Car Insurance
You, the hirer, will be asked to declare that you are 25 years of age or over and have not been convicted in a criminal court for any criminal offence or for driving under the influence of drugs or alcohol. The hirer will be asked to complete an 'Agreement to Hire' form prior to starting their tour.
Our MX-5's have comprehensive insurance. a security bond of $2,000.00 is taken on the signing of the rental agreement by way of a signed credit card voucher which is authorised but unprocessed pending the return of the car undamaged. If the car or any third party property has suffered damage or loss we will make an assessment of the monetary value of such damage or loss and, under advice to you, will deduct this value from the security bond held.
Insurance cover is voided and the hirer is fully liable for all costs if:
1. Any of the terms of the rental agreement are breached
2. Damage to property is caused by careless, reckless or wilful driving including the driver being under the influence of alcohol or drugs
3. Damage to property is caused by submersion in water, such as river crossing, including salt water, resulting from driver negligence
4. Damage to property is caused by driving on unsealed roads, beaches or cross country
5. The driver's license is invalid, not current
6. The car was not locked overnight
7. The car was being driven in an unlawful manner, such as on the right-hand side of the road
